CONSTITUTIONAL CRISIS: 2025 POLITICAL UPHEAVAL

CONSTITUTIONAL CRISIS: If the Senate and the House of Representatives opted to deviate from the decision of the Supreme Court.

It happened already in the past where the Supreme Court issued an injunction over the impeachment trial of former President Estrada, but the Senate, convened as an impeachment court, did not heed to that order and proceeded to the trial.
The defense of the Senate at that time was that the impeachment proceeding is a "Political in character", therefore the Supreme Court, as co-equal branch of the government could not dip its finger to the political process in danger for the violation of the honored principle of Separation of Powers among the three equal branches of the government.
In light of the decision of the Supreme Court penned by Justice Leonen, he categorically mentioned that, "The process of impeachment is a constitutional and therefore legal process that takes place within a political movement. That it is sui generis does not convert it to a purely political process isolated from the requirements of the Constitution as a whole.
This Court, regardless of the political result, will not evade its duty to declare when an act is done with grave abuse of discretion amounting to an excess of jurisdiction of any department, organ or office.
